Host a calendar, list contacts, documents and more. Let the owners and residents have access to the information. This will provide users with the immediate answers to their questions and will reduce the phone calls and emails drastically.

Until recently, private investigators in the United Kingdom have not required any special licence. That situation looks likely to change soon, however.

In May 2001 the Private Security Industry Act was passed by the British Parliament. This paved the way for a system of licensing for the private security industry. The Act separated the industry into four key segments: door minders/bouncers, wheel-clampers, manned security and private investigators.

The licensing system is being implemented by the Security Industry Authority (SIA). Everything so far is running fairly smoothly, with the entire security industry in England and Wales being regulated as from 2005 on a sector by sector basis. The PI sector is last on the list, and at the time of writing (August 2008) there is still no definite date for the introduction of licensing for PIs.

At present it is too early to say exactly how the new licensing system for private investigators will operate. However, the SIA say that operators will need an SIA licence “if they are engaged in surveillance, inquiries or investigations for the purpose of obtaining information about a person or person(s) activities or whereabouts, or the circumstances by which property has been lost or damaged.”

The SIA say that the following activities will NOT require a licence:

* activities exclusively for the purposes of market research;

* activities exclusively concerned with a credit check;

* professional activities of practising solicitors and Barristers;

* professional activities of practising accountants;

* professional activities of journalists and broadcasters;

* activities exclusively relating to reference to registers which are open to the public; registers or records to which a person has a right of access; and published works; and

* activities carried out with the knowledge or consent of the subject of the investigation.

Once licensing is introduced, anyone involved in providing contracted private investigation services will need a licence. This includes employees, employers, managers, supervisors and directors or partners of private investigation companies.

According to the SIA website (see below), a partial Regulatory Impact Assessment (RIA) has been carried out on the licensing of private investigators. This was a wide-ranging review, which looked at a range of options, and all interested parties were invited to submit their comments. The next stage is that the Home Office will publish a full Implementation Impact Assessment (IIA) that will give details of the approach to be taken. As yet there is no indication on when the IIA will be published.

The above sums up the information available about the proposed licensing of private investigators in England and Wales (and, by extension, Scotland and Northern Ireland) at the present time. For the very latest information, you may wish to check the SIA website at www.the-sia.org.uk. If you are currently considering becoming a private investigator, there is every incentive to proceed now before licensing is introduced. At present, there is no requirement for investigators to be licensed (although if, for example, your work involves collecting money on a client’s behalf, you may have to apply for a consumer credit licence). Once licensing comes in, however, would-be entrants to the profession may be required to obtain specific job-related qualifications, while those already working in the sector may qualify for full or partial exemption from this requirement.

Houses in Multiple Occupation (HMOs) have received a lot of press attention recently, both good and bad. As a result, people are now either wishing to jump onto the HMO bandwagon, or want nothing to do with them.

If you have any interest in property investment whatsoever, you must familiarise yourself with HMO regulations.

Landlords already running HMOs in England had until 3rd July 2006 to present their applications to their local councils. Any landlord who owns a property that has been let out to sharers may thus be breaking the law if he has not already registered that property.

From 6th April 2006, the Housing Act 2004, has meant that there is a new definition of a House in Multiple Occupation (HMO). Anyone considering a career in property investment in the UK should familiarise themselves with the Housing Act 2004. You can easily download this from the internet.

HMO legislation has been introduced for several reasons:

* To improve the condition of rented housing stock.

* To reduce the number of unscrupulous landlords letting substandard and potentially dangerous property.

* To improve management standards of rented property.

* (Indirectly) To increase revenue for local councils through what is effectively a landlord’s tax.

* (Indirectly) To compile a register of rented property stock.

It is hoped that HMO legislation will result in a much better deal for tenants by removing rogue landlords from the system. However, as with most things, the better landlords will now have to go through additional red tape to provide a similar service to what they have already been providing.

To get a HMO licence you will need to submit a completed application form obtainable from your local council. As part of your application, you will need to include floor plans providing room sizes and an indication of current fire precautions in your property. You will be required to prove the safety of any fire detection system by providing a certificate issue by a suitably qualified engineer.

You will also need to submit a current Gas Safety Certificate. You can obtain this from any CORGI registered gas engineer. An electrical safety inspection will also need to be conducted by a qualified electrician and an electrical safety certificate issued.

If you are providing any electrical appliances, you will need to have a PAT (Portable Appliance Testing) certificate issued by an electrician. This will cover items such as electric kettles and toasters etc.

You will also need to prove that you have suitable management arrangements in place. For example, deposit procedures, tenancy agreements and procedures for dealing with anti-social behaviour.

Rental Agreements vs. Leave and Licence Agreements

The terms rental agreement and leave and licence agreement are often used interchangeably, but in fact there is a significant difference between the two.

Rental Agreement

Rental agreements are also referred to as tenancy or lease agreements. In rental agreements, there is a transfer of interest from a lessor to a lessee. If the premises are given on tenancy, there is an element of irrevocably (or immovability) by the owner except on the grounds for eviction mentioned under the Rent Act.

Leave and Licence Agreement

The phrase “license” was defined in Section 52 of the Indian Easement Act, 1882 [ACT NO. 5 OF 1882] [17th February, 1882], as follows: “Where one person grants to another, or to a definite number of other persons, a right to do, or continue to do, in or upon the immovable property of the grantor, something which would, in the absence of such right, be unlawful, and such right does not amount to an easement or an interest in the property, the right is called a license”.

Licence does not create any interest in the premises in favour of the licensee excepting a mere right to use and occupy the premises for a limited duration in consideration of the price paid. Licence only creates a right or interest in the immovable property to do something, under the authority of the grantor of the licence.

Every license is governed by the provisions under the Indian Easement Act. When any property is given on leave and license, the agreement is known as leave and license agreement.

A leave and license agreement can be terminated according to the terms of the agreement, and the owner can demand the possession back from the licensee.

The classification of an agreement

The question whether a certain agreement to occupy an immovable property is an agreement to lease or an agreement of leave and license has been a subject of many court judgments.

Ever since the introduction of the Rent Acts and security of possession given to the tenants by law, agreements of license have come to be viewed with suspicion that they are a disguise taken by the landlords. According to the courts, the classification of an agreement and the real nature of the transaction has to be determined through construction of the document as a whole and not based on particular words used in the document.

From the various judgments it can be said that the tests laid down to decide whether an agreement is a lease or a license are – what was the intention of the parties and whether the agreement creates an interest in the property.

Where one person grants to another, a right to do something in the immovable property of the grantor, and such right does not amount to an easement or an interest in the property, it is a licence. A licence may be granted by anyone to the extent to which he may transfer his interests in the property affected by the licence. The grant of a licence may be express or implied from the conduct of the grantor, and an agreement which purports to create an easement, but is ineffectual for that purpose, may operate to create a licence.

The idea of property management (sometimes referred to as 3rd party management) has been around since the dawn of time. But, before property management was a job or career, a title or a company, property management has been an action that many people attended to around the land or buildings that they owned themselves or leased from someone else. Property management can mean different things to different people. For some, property management might mean keeping their own property safe, secure and pleasant to the eye. For others, property management could mean paying someone else to make sure your property is in tip top shape. Some types of properties that may need property management are; houses, condos, duplexes, town homes, apartments, shopping centers, malls, offices buildings, airports and public transportation buildings, hospitals and many more. Property management is very similar to the role of management in any business.

One important role that property management has is to act as the middle person between the tenant and the property management landlord. Property management should provide the property management landlord with a sense of security, knowing that everyday needs from the renter can be resolved without involving said property management landlord unnecessarily. Hand and hand with that security, the tenant can be assured that the property will be maintained to some set of standards which can be reviewed with the property management team before an agreement is reached. Property management is a delicate balance between pleasing the property management landlord and keeping the renter happy as well. The task of property management can prove to be harder than it sounds. Maintaining an open line of communication in property management and being able to address the needs of both property management parties will make a successful property management business. Property management takes an organized, well communicated, and dedicated individual or staff to be able to pull off a successful property management company. Typically property management companies will charge their landlords a percentage of the gross rent collected each month. This percentage for property management fees can range from 3 to 10% depending on the property management market. Sometimes a flat fee is more appropriate when the property is a condominium or a type of cooperative complex for property management. Some states might require that property managers have a property management license or a real estate license to be able to claim the title of property manager or property management business.

Since July 2006 landlords in England and Wales who own larger houses in multiple occupation – basically three storey properties let out to groups of unrelated people – have had to apply for licences from their local councils. If they do not do so they could find themselves fined up to 20,000 pounds and unable to collect their rents.

In Scotland landlords already have to licence HMOs. And from April all Scottish landlords will require a licence, no matter what type of rental properties they own.

In both Scotland and England and Wales, licensing of HMOs has been introduced primarily, say the legislators, as a safety measure particularly aimed at reducing the fire hazard in student digs. It is just the type of larger three storey properties typically rented as student bedsits that pose the biggest risks, they say.

However, the licensing of all landlords in Scotland has been introduced in the context of curbing anti-social behaviour by tenants. And there are some elements of this in the licensing of HMOs in England and Wales as well.

It was the Housing Act 2004 which brought in the requirement for HMO licensing in England and Wales. Other Housing Act measures included the introduction of the controversial Home Information Packs that from 2007 will be needed before properties can be sold, and the requirement that landlords participate in deposit protection schemes – as from next October.

Houses in multiple occupation are already subject to special rules and in some areas registration schemes, while many local authorities and universities already run voluntary landlord accreditation schemes. Local authority environmental health departments have always had powers to require work to be carried out to make sure that HMO properties are adequate and safe. However, the Housing Act provisions which come into effect next month will require all those properties within the statutory definition to be licensed.

Licensing will be in the hands of local authorities, which appear to be in various stages of preparedness. Some have yet to set their level of fees. Brighton & Hove, for example, has said it will set its licensing fees on 30 March and that it ‘hopes’ to have application forms ready very shortly after that date.

It is clear there will certainly be variations from local authority to local authority, especially on the level of fees, but also the promptness of inspections and other assessments.

All authorities will licence HMOs that fall within the statutory definition, some will also be using ‘additional’ licensing powers to licence other HMO properties. Most, it seems, have enough on their licensing plates for now and will defer any decision on additional licensing until later.

Leeds, for example, has said it intends to consider whether to apply additional licensing in a year’s time when it has dealt with all 8,000 HMOs in its area that its estimates will be subject to mandatory licensing. Meanwhile, Southampton has agreed to introduce additional HMO licensing, but when mandatory licensing is up and running.

Rushmoor Borough Council said it is planning to consult landlords, tenants and other interested parties on whether to license other types of HMO. ‘We would prefer to license all properties that currently have to be registered, including two storey properties’, it said.

Although the licences local authorities will issue are for properties rather than landlords, there will be three prongs to the licensing process, two involving landlords themselves. First local authorities will assess whether applicants are ‘fit and property’ to be HMO landlords and will have to be satisfied about the management standards they will apply. Later, or in some cases more immediately, will come inspections to ratify landlord statements that the properties themselves are fit for purpose. As licences will state the maximum number of people each property may house, this will include an assessment of the suitability of amenities for the intended number of tenants.

When it comes to management standards, licensed landlords will have a duty to take reasonable steps to ensure that tenants are not causing problems within the boundaries of the property through anti-social behaviour. Local authorities may in some instances put conditions on licences concerned with anti-social behaviour.

The Government has specified minimum amenity standards, setting out the requirements for kitchens, bathrooms and toilets in HMOs. Local housing authorities may use their own amenity standards if they are equal to or higher than the minimum standards. This means landlords will have to contact their local authorities to confirm the standards to be applied in their own areas.

In the case of properties with insufficient amenities for the number of tenants the landlord wishes to house, local authorities will include conditions within licences stipulating that the required extra amenities are provided within a specific time. Alternatively they could grant licence for lower maximum numbers of occupants. In some instances they may even conclude that a licence cannot be granted until the condition and amenities within a property are improved.

The new Housing Health and Safety Rating System, which applies to all residential property, also comes into effect next month. When licensing HMOs, local authorities will have to satisfy themselves that there no ‘category one’ hazards within properties. They may carry out HHSRS inspections to verify this prior to granting licences or at a later date.

HHSRS covers 29 different areas of risk, considerably extending the current nine point housing Fitness Standard. Assessment of these risks will culminate in a ‘hazard rating’ applicable to each property. Your software should care for your daily business needs, reduce the time spent on mundane administrational tasks and prevent costly mistakes by checking and cross checking the information in the database. This will result in your staff having more time to for customer service and business development.
